Terms of Use

1. About these Terms, and your agreement

These Terms of Use (“Terms”) are a binding agreement between you and Merago Healthcare Technologies Pvt. Ltd., a registered company with the Registrar of Companies India. The company governs your access to and use of the Service.

By creating an account, or by accessing or using the Service, you agree to these Terms and to our MERAGO One Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of another person you are authorized to represent, you accept these Terms for them.

Read these Terms together with the Privacy Policy, any consent or notice presented in the app, and any separate terms of a clinician or partner you engage through the Service. Where a more specific partner term conflicts with these Terms for the service it covers, that term controls for that service.

Electronic record. This is an electronic record generated by a computer system and does not require a physical or digital signature. Where applicable (for example, under India's Information Technology Act, 2000 and the Indian Contract Act, 1872), these Terms are enforceable as an electronic agreement.

3. What MERAGO One is — and is not

MERAGO One is an information and wellness tool that helps you understand and organize your own health information and learn general health facts. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for a qualified clinician. Using the Service does not create a doctor–patient relationship between you and Merago.

Always consult a qualified clinician about your health and before making any decision based on content in the Service. Any reliance on the Service is at your own risk.

4. Ask Belinda and AI outputs

Ask Belinda uses automated (AI) technology to explain and organize your information and answer general questions in plain language. It helps you read your own results and learn what markers generally mean; any “out of range” flags come from your lab's own report.

To generate responses, your query may be processed by our systems and by vetted third-party AI providers acting as our processors, as described in the Privacy Policy. You are responsible for how you use AI outputs, and you should verify anything important with a qualified clinician.

5. Emergencies

The Service is NOT for emergencies. If you think you may have a medical emergency, or are in crisis, call your local emergency number or go to the nearest emergency facility immediately. Do not disregard or delay professional advice because of anything in the Service, and do not rely on the Service, Ask Belinda, or Emergency Info features for emergency response.

6. Clinical services, providers, and related disclaimers

Independent providers. Where the Service lets you connect to care — for example through My Doctor / My GP, Find Care Nearby, a consultation, a lab test, or a pharmacy order — those services are provided by independent, appropriately licensed clinicians, pharmacies, laboratories, or partners, not by MERAGO One. Merago provides the technology and coordination that help you reach them, and the treating clinician or partner is solely responsible for the clinical services they provide (including diagnosis, treatment, prescribing, dispensing, and their own records), under the rules of their jurisdiction (for example, in India, the National Medical Commission's Telemedicine Practice Guidelines). MERAGO One does not itself practice medicine, prescribe, or dispense.

No endorsement. Listings, search results, and directory information are not recommendations. We do not endorse any specific clinician, pharmacy, laboratory, medication, product, or procedure, and any reliance on a third party found through the Service is at your own risk.

Telehealth risks. If you use telehealth or connect features, you acknowledge inherent risks, including that transmitted information may be insufficient (for example, poor image quality) for a decision, that technical failures may cause delays, that incomplete records could contribute to errors, and that — despite safeguards — no electronic transmission is completely secure.

Not insurance. MERAGO One is not an insurer and does not provide insurance. Fitcoins, HealthScore, and similar features are not insurance or financial products.

7. Your content

You keep ownership of the content you add — your records, notes, messages to Ask Belinda, and other information. You grant Merago a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and adapt your content only to operate, provide, secure, support, and improve the Service, consistent with the Privacy Policy. Our use of de-identified and aggregated data is described in the Privacy Policy.

You represent that you have the rights to the content you add, that it is lawful, and that where you add another person's information you are authorized to do so. Don't upload content that is unlawful, infringing, defamatory, obscene, harmful, or that you have no right to share.

You are responsible for any data or carrier charges you incur, and for using secure networks. We may investigate and take action — including removing content and suspending or terminating access — for conduct that breaches these Terms.

9. License to use the Service

Subject to these Terms, Merago grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal, non-commercial health and wellness purposes. We reserve all rights not expressly granted, and the restrictions in Section 8 apply.

10. Fitcoins

Fitcoins are non-cash engagement points that recognize healthy habits. They are not currency, credit, or a payment instrument, cannot be exchanged for cash and may be used only as discount incentives by us. They are non-transferable, may expire, and we may change, limit, or discontinue them at any time.

11. Fees, payments, cancellations, and refunds

MERAGO One is free to download and use for its core features. We may introduce optional paid features or region-specific plans, communicated in the app or in updated Terms. Some services you access through the app — such as a consultation, lab test, or pharmacy order from a clinician or partner — may carry fees, collected by the provider/partner or by us on their behalf through our payment processors compliant with all applicable regulations. We do not store your payment-card details.

Transparency. Before you confirm any purchase, we show the total price (including applicable taxes), what you get, and any limits. We do not use “dark patterns” such as pre-checked boxes or misleading buttons. A tax invoice (for example, a GST invoice with our GSTIN, in India) is available on request for paid services.

Cancellations and refunds follow the terms shown at purchase and the applicable provider/partner policy. Where a refund is due, we may issue it to your original payment method or as an in-app credit or coupon at our discretion, processed within 30 days. Some bookings may be non-refundable after a stated cut-off, and case reviews may be closed if you don't respond within the stated time.

12. Advertising

MERAGO One does not display third-party advertising in the app, and we do not use your health data for advertising or sell it, as described in the Privacy Policy. If we ever introduce any promotional content, we will do so consistent with the Privacy Policy and applicable law, and health data will not be used to target it.

13. Electronic communications, calls, and notifications

Electronic communications. When you use the Service or contact us, you are communicating with us electronically and consent to receive communications from us electronically; electronic notices and agreements satisfy any legal requirement that they be in writing. To keep a copy of these Terms, print or download them.

Service messages. We may send you messages necessary to the Service — for example security alerts, medicine or appointment reminders you set, and account notices — through push notifications, SMS, email, or calls. Promotional messages are sent only with your consent, and you can opt out of them (for example, in-app settings, unsubscribe links, or by replying STOP to texts) without losing service messages.

Verification. We may ask you to verify your identity or account information to prevent fraud or unauthorized access. If you don't provide requested information within 07 days, we may suspend or limit access until you do.

14. Third-party services, links, and app stores

The Service may link to or integrate third-party services (for example clinicians, labs, pharmacies, maps, or wearables) and is distributed through third-party app stores. We are not responsible for, and do not endorse, third-party services or content, and your use of them is subject to their own terms and privacy notices. You are responsible for any fees third parties charge you. Section 24 sets out additional app-store terms.

15. Intellectual property

Except for the content you add (including your medical records), the Service — including the MERAGO One app, Ask Belinda, software, content we provide, and the “MERAGO”, “MERAGO One”, “Ask Belinda”, and “Fitcoins” names and logos — is owned by Merago or its licensors and protected by intellectual-property laws. Except for the limited license in Section 9, these Terms give you no rights in our intellectual property, and you may not copy, frame, or use our marks without written consent.

Feedback. If you send us ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

16. Copyright and intellectual-property complaints

We respect intellectual-property rights and respond to valid notices under applicable law. If you believe content on the Service infringes your rights, send a written notice to our Grievance Officer (Section 25) that includes: identification of the work and of the allegedly infringing material (with its location/URL); your contact details; a good-faith statement that the use is not authorized; a statement that the information is accurate and that you are the owner or authorized agent; and your name and signature. We may remove content and, in appropriate cases, disable repeat-infringer accounts.

17. Privacy

Our handling of your information is governed by the MERAGO One Privacy Policy, which explains what we collect, how we use it (including how Ask Belinda and our AI features work), when we share it, your rights, and how we handle data across regions. By using the Service, you acknowledge the Privacy Policy.

18. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, security, or availability, to the fullest extent permitted by law.

We do not warrant that the Service or any content (including Ask Belinda outputs) will be accurate, complete, current, uninterrupted, secure, or error-free; the Service may contain occasional errors, and we may correct, change, or withdraw features at any time. We are not responsible for the services, acts, or omissions of independent clinicians or partners, or for transmission errors outside our control. Nothing here excludes any warranty or right that cannot be excluded under the law that applies to you.

19. Limitation of liability

To the fullest extent permitted by law, Merago and its group companies, officers, employees, suppliers, and partners will not be liable, under any theory, for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, or for your reliance on the Service.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, but not exceeding INR 5,000 whichever is lower.

Nothing in these Terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, for fraud, or for your mandatory rights as a consumer. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

20. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Merago and its group companies, officers, directors, employees, agents, and partners from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or the Privacy Policy, your content, your misuse of or access to the Service, or your violation of any law or third-party right. We may assume the exclusive defense of any matter subject to indemnification, and you will cooperate with us.

21. Suspension and termination

You may stop using the Service and close your account at any time through the app. We may modify, restrict, suspend, or terminate your access — or any feature — if you breach these Terms, if required by law, or to protect the Service or others. On termination, the license in Section 9 ends; sections that by their nature should survive (including content license, disclaimers, limitation of liability, indemnity, and governing law) continue. You can export or delete your data as described in the Privacy Policy.

22. Changes to the Service and these Terms

We may change, suspend, or discontinue the Service or any feature, and we may provide updates at our discretion, without any obligation to continue releasing new versions. We may also update these Terms; if a change is material, we will give prominent notice (for example, in the app) and, where required, obtain your consent. The “Last updated” date shows the current version, and continued use after changes take effect means you accept them. If you don't agree, stop using the Service.

23. Governing law and dispute resolution

Informal resolution first. Most concerns can be resolved quickly — please contact us at support@merago.com before starting formal proceedings, and we'll try to resolve it within 30 days.

Governing law and forum. These Terms are governed by the laws of India. Subject to the arbitration provision below, the courts of Bengaluru, Karnataka, India have exclusive jurisdiction.

Arbitration. Where permitted, any dispute not resolved informally may be referred to arbitration by a sole, neutral arbitrator, conducted in English under the Arbitration and Conciliation Act, 1996 (India), seated in Bengaluru, India. Nothing here prevents either party from seeking injunctive or equitable relief from a court to protect intellectual property, data security, or other rights.

Your local consumer rights. If you are a consumer in the EEA, the UK, India, or another jurisdiction whose law gives you mandatory protections, nothing in this Section deprives you of those protections or of the right to bring proceedings in your local courts, and the mandatory law of your country of residence continues to apply.

24. App stores and devices

Apple App Store. If you obtain the app from the Apple App Store: these Terms are between you and Merago, not Apple; Apple has no obligation to provide support or maintenance; Apple is not responsible for the app, any claims about it, or any third-party intellectual-property claim; if the app fails to conform to any applicable warranty, Apple may refund the purchase price (if any), and otherwise has no warranty obligation; and Apple is a third-party beneficiary entitled to enforce these Terms.

Google Play. If you obtain the app from Google Play: these Terms are between you and Merago, not Google; your use must comply with the Google Play Terms of Service; Merago (not Google) is solely responsible for the app; and Google is a third-party beneficiary of these Terms.

Devices and support. We are not liable for errors or unreliable operation resulting from rooted, jailbroken, or otherwise modified devices or operating systems. For support, email support@merago.com; we use commercially reasonable efforts to respond during the hours of 9 AM to 5 PM India Standard Time, Monday through Friday on Merago business operating days in India.

If you have a complaint about content, these Terms, or how we handle your information, contact our Grievance Officer:

We will acknowledge your complaint within 48 hours and endeavor to resolve it at the earliest possible. Privacy-specific requests are also handled as described in the Privacy Policy.
